Hi there, Andrew Koleda from On Demand HR here with a short HR update covering some changes to the National Employment Standards which may impact your business.

Employees, including casual employees, are entitled to compassionate leave (or bereavement leave) for each occasion that someone dies or contracts or develops a life-threatening illness.

On 10 September 2021. the Fair Work Act 2009 was updated to include miscarriage as a reason to access compassionate leave.

Historically, a woman who experiences a miscarriage, and her partner or support network would need to access personal or annual leave for the purposes of taking time off work as a result of a miscarriage.

In response to the Respect at Work bill miscarriage has been included as a reason to access compassionate leave. This means that a female experiencing a miscarriage may be awarded 2 days off work to assist in recovery. For permanent staff this is 2 paid days off.

It also means that a member of her immediate family or household may also access the same entitlement to provide her with support during this time.
